Terms of Service

1. Who provides SellerTemplate

SellerTemplate is operated by Kamil Praczyk, an individual sole trader trading as SellerTemplate. You can contact the operator at clingykoala.ask@gmail.com.

2. Accepting these terms

By creating an account or using the service, you agree to these terms. If you do not agree, do not use SellerTemplate. You must be legally able to enter into a contract to use paid features. If you use the service for a business, you confirm that you are authorised to accept these terms for it.

3. The service and availability

SellerTemplate provides tools for designing reusable eBay listing description layouts, saving templates, importing information from supported listing pages, previewing designs and generating standalone HTML for an eBay description. It does not create or publish your complete eBay listing. You remain responsible for the listing title, price, item specifics, postage, images and publishing decisions.

We work to keep the service available and secure, but do not promise uninterrupted, error-free access or that every feature will work on every device, browser or eBay surface. We may update, restrict or pause features for maintenance, security, legal compliance, provider changes or other operational reasons. Where a change materially affects a paid feature, we will take reasonable steps to give notice where practical.

4. Your account and security

Provide accurate account details, keep your sign-in methods secure and use your own account. You are responsible for activity carried out through your account unless it results from a security failure for which we are responsible. Tell us promptly at clingykoala.ask@gmail.com if you suspect unauthorised access.

We may restrict or suspend access immediately if reasonably necessary to address a security risk, suspected fraud, unlawful activity, abuse, non-payment or a material breach of these terms. Where practical, we will explain the reason and provide a way to contact us about the decision. While we investigate, access to templates, generated history and credits may be temporarily restricted. If we permanently close an account because of a material breach, unused credits may be made unavailable only to the extent permitted by law. We may preserve records needed to investigate abuse, protect the service or comply with law.

5. Your templates and content

You keep your rights in content you provide. You give us a limited, non-exclusive permission to host, copy, transmit, display and process that content only as needed to operate, secure, troubleshoot and support the service. This permission ends when your content is deleted from the service, except for copies retained temporarily in backups, records required by law or records needed to resolve a dispute or protect the service.

You confirm that you have the rights and permissions needed for the text, images, logos and other material you add. You are responsible for its accuracy and for reviewing imported details and generated HTML before use. Do not submit unlawful, infringing, deceptive, malicious or confidential material you are not authorised to share. We do not claim ownership of your content or use it to advertise the service.

6. SellerTemplate intellectual property

SellerTemplate and its licensors retain ownership of the service, software, interface, design system, documentation, brand and included assets, excluding content you provide and third-party materials. While your account is in good standing, we grant you a limited, non-exclusive, non-transferable licence to use the service and to use its generated output in your own eBay item descriptions. You may not resell access to the service, copy or redistribute its underlying assets as a standalone asset library, or remove notices identifying third-party rights.

7. Generated HTML and eBay

Generated HTML is provided as a starting point for you to review. You must check that it is accurate, suitable for your item and permitted by eBay’s current rules before adding it to a listing. We do not guarantee that eBay will accept, display or preserve any particular design, image, link or formatting, or that using the service will increase sales or prevent listing restrictions.

eBay is a separate service. We do not control its policies, listing display, availability or decisions. You are responsible for obtaining permission to use product images and third-party content. SellerTemplate is not affiliated with, endorsed by or operated by eBay Inc. or its affiliates. “eBay” describes the intended use of the generated description only.

8. Generation Credits and payments

Some HTML generation features use Generation Credits. The available one-time packages and total prices are shown before checkout. Current packages are 50 credits for £8.99, 100 credits for £12.99 and 200 credits for £19.99. Stripe processes payment; we do not receive or store your full payment-card details. The package and price accepted at checkout apply to that purchase; later price changes do not change completed purchases.

A new account receives 15% off all Generation Credit packages for six hours from account creation. During that period, the Generation Credits screen shows the discounted total, the regular total and the time remaining. Current discounted totals are £7.64 for 50 credits, £11.04 for 100 credits and £16.99 for 200 credits. The price shown at checkout is the amount charged for that purchase.

A new account also receives one welcome Generation Credit for one successful new HTML generation. It is available for six hours after it is granted, cannot be transferred or exchanged for cash, and expires unused at the end of that period.

Credits are linked to the purchasing account, cannot be transferred or sold, and may only be used for the service. A successful new HTML generation uses one credit. If the service reuses an identical generated result that is still retained, another credit is not used. We may correct an obvious account display error after checking the relevant transaction records.

We do not offer discretionary refunds for Generation Credit purchases. This does not remove any cancellation, refund or other remedy required by applicable law. Contact clingykoala.ask@gmail.com if you believe a statutory right applies. Nothing in these terms limits those rights.

9. Saved templates and generated history

Your saved listing designs are kept until you delete them, your account is closed, or three years pass without an update to the design, whichever happens first. A saved design’s three-year period restarts when you update it. Expired designs are removed from your account and may then be permanently deleted. Generated HTML copies in Created templates are retained separately for up to two years from creation and may then be permanently deleted. Save a copy of any output you need to keep. Deletion by cloud storage systems can take additional time after an item expires.

You can permanently delete your account from the account menu. This removes your account, saved templates, generated HTML history and remaining Generation Credits. Limited payment records may be de-identified and retained where required for accounting, legal or dispute-handling purposes. Account deletion does not itself process a refund; any refund rights that apply under law remain unchanged. This deletion does not remove records held by Stripe or other providers.

10. Acceptable use

You must not:

• break the law or infringe another person’s rights using the service;
• submit content you do not have permission to use or distribute;
• bypass authentication, payment, credit, rate or access controls;
• probe, disrupt, overload, reverse engineer or interfere with the service, except where applicable law does not allow that restriction;
• scrape, copy or automate access in a way that harms the service or other users; or
• use the service to distribute malware, spam, scams or misleading listings.

We may remove prohibited content and take proportionate steps to stop or prevent a breach, including limiting or closing access as described above.

11. Responsibility and liability

We will provide the service with reasonable care and skill. Nothing in these terms excludes or limits a responsibility or remedy that applicable law does not allow us to exclude or limit. This includes mandatory consumer rights and liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

You are responsible for decisions you make using the service, including checking your item information, permissions, Generated HTML and eBay requirements before publishing. We are not responsible for a third party’s actions or changes, or for losses caused by content or instructions you provide, to the extent those losses were not caused by our breach of these terms or another duty we owe you.

If you use SellerTemplate wholly or mainly for business purposes, then, to the extent the law permits, we are not liable for indirect or unforeseeable loss, loss of profit, revenue, business opportunity, goodwill or anticipated savings. Our total liability for business claims arising in any rolling 12-month period is limited to the amount you paid us for SellerTemplate in that period. These limits do not apply to liability that cannot legally be limited. If you use SellerTemplate as a consumer, this paragraph does not remove any rights or remedies you have under consumer law.

12. Ending or changing the service

You may stop using SellerTemplate at any time. We may suspend or end your access for a serious or repeated breach, legal requirement, security risk or if we stop providing the service. Where practical, we will give notice and explain the reason. We will not use a suspension or termination to remove rights or remedies you have under applicable law.

We may update these terms to reflect service or legal changes. We will post the current version here and update the date above. Changes apply from publication for future use. If a change materially affects an existing paid purchase, we will take reasonable steps to notify you; your legal rights remain unaffected.

13. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, such as internet or cloud-provider outages, power failures, cyberattacks, government action or changes made by eBay or Stripe. We will take reasonable steps to reduce the effect and resume affected service when practical. This clause does not affect payment refunds or other remedies required by law.

Contact us about these terms, account access, a payment or a complaint at clingykoala.ask@gmail.com. Include the account email and relevant payment or request reference, but do not send full card details or passwords.

15. Governing law

These terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply where you live. The courts of England and Wales will hear disputes where the law allows.
